Reflects on the constitutional changes brought about by the 1967 Referendum, evaluating its impact and legacy; discusses the silences in the Constitution, i.e. the absence of Indigenous people from the drafting process and the substance of the Constitution; the legacy of the silences is also born out in the 1997 High Court case of Kruger v The Commonwealth which highlights how few of our rights are acutally protected by the legal system; discusses the expectations of the campaigners at the 1967 Referendum, including the expectation that the race power Section 51 (xxvi) if changed would be used in a benevolent way by the Commonwealth; however the power has been used in a disadvantageous way in the passing of the native Title Amendment Act 1998 which prevents the Racial Discrimination Act 1975 from applying to certain sections of the Native Title Act 1993; the High Court discussed the use of the race power in the case Kartinyeri v Commonwealth; the referendum did not create an even playing field or an era of non-discrimination as many 'yes' voters envisaged, however it was a high water mark in the relationship between Aboriginal and non-Aboriginal people (p. 7); also discusses how the notion of inclusion in the census arising from the 1967 Referendum was seen at the time as somehow creating a more cohesive community, however Behrendt argues that there still exists an "us" and "them" relationship today, particularly in the area of native title rights
