- Summary
- Argues for the absolute centrality to anthropology of "fine-grained ethnographic material"; the need for anthropological evidence both under the Aboriginal Land Rights (Northern Territory) Act and the Native Title Act have reinforced this; discusses the conflict between definitions of native title which derive from traditional law and are negotiated among groups and the western legal approach which would define native title as itemised and separable rights; disputes may arise between Indigenous groups because of overlapping claims and differential rights and competing rights and responsibilities; disputes may also arise because of a contradiction in the Native Title Act in which individual rights are separated from and opposed to collective rights; accurate ethnography can reflect the dynamic relationships between subjects, researchers and the academy
